Acceptance of Terms

By accessing or using this service, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.

Description of Service

We provide a software-as-a-service platform. We may modify, suspend, or discontinue any part of the service at any time, with reasonable notice where possible.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use or security breach.

Acceptable Use

You agree not to:

• Violate any applicable laws or regulations.
• Infringe on the intellectual property or other rights of any party.
• Attempt to gain unauthorized access to our systems or data.
• Interfere with or disrupt the integrity or performance of the service.
• Use the service to send spam, malware, or other harmful content.

User Uploads and Generated Content

These rules apply to every photo, video, audio file and prompt you add to the service, and to everything you create with it. By uploading, you confirm that you have the rights and permissions needed to use that material here.

• Yourself or consenting adults only. Upload photos or videos of real people only if they show you, or an adult who has agreed to you using them to create this content. Old family photos of relatives who have died may be animated for personal remembrance.
• No minors. Do not upload photos or videos of anyone under 18, and do not create content that shows or suggests a real minor.
• No public figures. Do not upload or name celebrities, politicians, athletes, or other public figures to create content about them.
• No impersonation. Do not pretend to be someone else, and do not suggest that a person said, did, or approved something they did not.
• No misleading or non-consensual content. Do not create content that misleads viewers about who is shown or whether events are real, or that harasses, shames, or targets a person without their consent.
• No sexual content. Do not create sexual or sexually explicit content of anyone.

Videos and images made here are AI-generated. Do not present them as real footage, and follow the AI-labelling rules of any platform where you share them.

We may refuse a generation, remove content, and suspend or close accounts that break these rules. To report content that uses your image without your permission, contact support@tryh3.com.

Payment and Billing

Paid features are billed in advance for the selected billing period. You are responsible for providing accurate billing information. Failed generations receive automatic credit reversals. Cash refund requests are handled case by case under our Refund Policy.

Intellectual Property

The service and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

Commercial Use License

Eligible completed videos and images generated on TryH3 using credits from a successfully paid subscription or purchased credit pack, including bonus credits supplied with that purchase, may be used in advertising, brand campaigns, client deliverables, business projects, and monetized content, to the extent permitted by the applicable model and service provider terms.

Free previews, welcome-credit generations, and other evaluation outputs are for evaluation only. A later purchase does not retroactively grant commercial permission to those outputs. Outputs funded by refunded, reversed, or fraudulent purchases are excluded. Where a generation combines paid and evaluation credits, contact support with its task ID to confirm its coverage.

For eligible works already created, commercial permission continues after cancellation or expiry of the subscription or exhaustion of the purchased credits, subject to these terms and any applicable model or provider restrictions. New works must independently qualify for commercial use.

Paid customers can request an account-level Commercial Use License Certificate from their avatar menu. The certificate records the account holder, a qualifying paid order, its issuance date, and the applicable license terms version. Its qualifying order confirms the account's paid purchase; it is not a list of every covered work or a blanket license for all outputs. Keep the relevant task IDs and purchase records with individual project files. Certificate details are saved when first issued; contact support if those details need correction.

The certificate is issued by TryH3. It is not a copyright registration, proof of exclusive ownership, third-party rights clearance, or certification by a model provider. You remain responsible for obtaining permission for uploaded material, likenesses, trademarks, music, and other protected elements, and for complying with applicable law and model/provider restrictions. We grant only the commercial permissions we are entitled to grant.

For a purchase or certificate that cannot be verified, contact support@tryh3.com with your order reference or certificate number.

Termination

We may suspend or terminate your access to the service at any time if you violate these terms. You may close your account at any time through your account settings.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the service.

Changes to These Terms

We may modify these Terms at any time. We will notify users of any material changes by updating the date at the top of this page and, where appropriate, sending a notice through the service.
